Under Arizona law, a person commits “Aggressive Driving” if they are alleged to have driven in a manner that poses an immediate hazard to another person or vehicle, while speeding or committing at least 2 of the following:

Failing to obey a traffic control device
Overtaking and passing another vehicle on the right side by driving off the pavement or main travel portion of the roadway
Committing an unsafe lane change
Tailgating
Failing to yield right of way

POSSIBLE PENALTIES FOR AGGRESSIVE DRIVING

Aggressive Driving is a class one (1) misdemeanor. The possible penalties for that class misdemeanor is up to 3 years of probation, up to six (6) months in jail, and up to a $2,500 fine plus surcharges. In addition to these penalties, a judge may also order the defendant to complete traffic survival school and up to a thirty (30) day suspension of their driver’s license.

If someone gets convicted of a second Aggressive Driving charge within 24 months of the most recent conviction, then they also face a possible driver’s license revocation for up to one year.
