Tempe is popularly known as a college town. In fact, it may be the best-known college town in Arizona. When school is in session at Arizona State University, the atmosphere is always one of parties and jubilation, especially after the sun goes down. Between the many bars within Tempe Marketplace and Mill Avenue and the festivals and concerts at Tempe Town Lake, there are a plethora of places for college students and other folks to have fun.

However, too much fun can lead to trouble. With Tempe’s party reputation, it stands to reason that local police are always on the lookout for drunk driving or some underage shenanigans. The police force is kept busy, and it is not unusual to be pulled over for suspected drunk driving.

Driving under the influence (DUI) is an offense that deals with operating any motor vehicle under the influence of alcohol or any other illegal substances.

DUI is a severe matter in Tempe, Arizona, and most times, DUI charges are seen as felony-level offenses. To beat one successfully, you must have a professional criminal defense attorney to help guide you through the tedious and possibly life-changing process.

Local DUI Laws Explained by a DUI Lawyer

Drunk driving of any kind is taken very seriously in the state of Arizona. Sometimes, DUI can lead to more severe crimes depending on how it happens, if an injury to someone else occurs, or other factors involved. A DUI case can become a vehicular manslaughter case if the drunk driver hits and kills someone, for example.

In Arizona, DUI is considered a Class 1 misdemeanor for a first-time offense, but this could change if some aggravating factors are involved. For example, if you have been arrested for driving under the influence previously, the criminal charges become much more serious.

Because of the grave nature of these charges, DUI and other criminal cases should be taken seriously. Hiring an experienced, professional law firm to help you in court should be a priority.

In Arizona, the law states that a person should not drive or be in physical control of a vehicle under any of these circumstances:

  1. While under the influence of liquor, a vapor-releasing toxic substance, any drug or a combination of the three elements of the individual is impaired even if it’s slightly. ARS 28-1381(A)(1).
  2. If an individual has a body alcohol concentration of 0.08 and above while driving or being in physical control of a vehicle. The alcohol must have been consumed before or while driving or being in physical control of a vehicle. ARS 28-1381 (A)(2).
  3. If there is any drug or its metabolite found in the individual’s body system. The drugs that are positive for this are defined in ARS. ARS 28-1382 (A)(3).
  4. If the vehicle being driven is a commercial vehicle that requires the driver to have a commercial driver’s license and the individual has an alcohol concentration of 0.04 and above. ARS 28-1382 (A)(4)

Arz- DUI cases vary, but no matter what situation you’re facing, you should have a solid DUI attorney on your side. Though it is illegal everywhere in the US, drunk driving statistics and laws vary somewhat throughout the United States. You should hire a local attorney for the best results. Look for a strong and experienced criminal defender with in-depth knowledge of how Arizona DUI cases are investigated, handled, prosecuted, and defended.

Individuals that have been served DUI charges should know a few options and process items to watch out for. For example, although you may refuse to take a breath test, this can result in losing your driver’s license.

As another example, Tempe police are not required to read your Miranda rights during your arrest. They do need to read them to you after your arrest and before any questioning.

Little details in the DUI process like these can get you into trouble if you aren’t aware of them. This is why you should have solid criminal defense attorneys just a phone call away.
